In our repository, we have had Branch Protection on our default branch, with (amongst other things) a Merge Queue enabled. We migrated all of the rules from Branch Protection to Rule Sets, however, once we deleted the Branch Protection, the MQ was removed from the repository. This blocked all PRs from being merged, because the Rule Sets stated that a MQ must be used, but there was no MQ on the repo. We've had to add a Branch Protection back into the repo in order to create the MQ.
Is this a bug or missing feature? I would assume that if you create a Rule Set that has the "Require Merge Queue" option enabled, then a MQ would be added to the repo, just as it is with Branch Protection.
